If a driver hits the back of another car while it is stationary at a traffic signal, he is considered as having committed a tort, and is referred to as the "tortfeasor,” "wrongdoer” or “defendant.” Personal injury law is classified in three broad categories namely, negligence, intentional torts and strict liability torts. Each category is comprised of different types of legal wrongs and indicates a different "standard of care" that is applicable to a given incident. A claim for personal injury must be proven in the court of law, in order to receive monetary damages. For example, if an individual were to slip and fall due to someone else's negligence, he is not entitled to recover damages unless injured in some way.
The Georgia Tort Claims Act establishes an exclusive remedy for any tort committed by a state officer or government employee. An individual cannot file a lawsuit against an employee of the state government. The lawsuit must be brought against the state government entity that the officer or employee was representing. The Act does not protect state officers or employees from being sued in connection with torts committed while they are acting outside the scope of their employment.
Before any lawsuit is filed, the plaintiff is required to provide written notice of the claim to the Department of Administrative Services. Notice must be given within twelve months of the date the loss was discovered. It is advisable to contact an attorney to file such claims and follow up on the legal rights.
